Quick Answer: Is MELBET Legal in India in 2026?

As of 1 August 2026, MELBET should not be described as a legal or India-authorised online betting service.

India’s legal position changed materially after the Promotion and Regulation of Online Gaming Act, 2025 and the Promotion and Regulation of Online Gaming Rules, 2026. The Rules came into force on 1 May 2026, operationalising a nationwide framework that prohibits online money games, their promotion and the processing of related financial transactions. The central framework applies to services offered to people in India, including relevant services operated from outside India.

MELBET offers sports betting, casino games and other products in which users stake money for the possibility of receiving monetary winnings. Those features fall within the Act’s broad definition of an “online money game,” regardless of whether the game is presented as one of skill, chance or a combination of both.

MELBET’s foreign licence does not change that conclusion. The Curaçao Gaming Authority’s public certificate currently identifies melbet.com as operated by Pelican Entertainment B.V. under an active Curaçao licence. That licence may authorise the operator under Curaçao’s regulatory system, but it does not amount to permission from an Indian authority and does not override Indian central or state law.

The position of an individual user is more complicated than the position of the operator. The central Act’s principal offence provisions focus on offering online money games, advertising them and facilitating financial transactions. State gambling statutes may create additional offences, and a user’s conduct can also raise banking, fraud, tax or investigative issues. Therefore, it would be equally misleading to say that every Indian user is automatically criminally liable or that individual users face no legal risk.

The safest accurate answer is:

MELBET is not licensed or authorised to offer online money gaming in India, and its real-money services fall within the type of activity prohibited by the current central framework. A working website, an INR balance, a UPI option or a foreign licence is not evidence that the service is legal in India.

MELBET Legal Status in India: 2026 Verdict at a Glance

QuestionCurrent position
Is MELBET licensed in India? No Indian licence or authorisation has been identified.
Does MELBET’s Curaçao licence make it legal in India? No. A foreign licence does not override Indian legislation.
Are real-money betting services prohibited under the PROG framework?Yes. The central framework prohibits online money games, their advertising and related payment facilitation.
Does the framework cover offshore operators? It is designed to apply to services offered within India, including relevant operations based outside India.
Is a reachable MELBET website proof of legality? No. Technical availability and legal permission are separate questions.
Is using a mirror domain or VPN a legal solution? No. A technical workaround does not change the legal character of the underlying service.
Are MELBET winnings tax-free?No. Online-game winnings can create Indian tax obligations even when the operator is offshore.
Is every individual user automatically prosecuted? The law does not support such a simple blanket statement. User exposure depends on the central provisions, state law and the person’s conduct.
Can an Indian regulator resolve a MELBET payout dispute?Indian consumer and banking protections may be difficult to enforce against an offshore operator that lacks Indian authorisation.

Why Older “Legal Gray Area” Answers Are No Longer Enough

Before the latest central legislation, many articles described offshore betting in India as a “gray area.” That description came from a genuine legal problem: the Public Gambling Act, 1867 was written for physical common gaming houses long before websites, mobile applications, digital wallets and offshore servers existed.

The 1867 Act remains relevant to the history of Indian gambling law. It deals principally with keeping or visiting common gaming houses and does not contain a modern framework written specifically for internet betting platforms.

For years, this gap encouraged several recurring arguments:

  • The operator’s server was outside India.
  • The user was betting privately rather than visiting a physical gaming house.
  • No single central statute expressly named the particular foreign brand.
  • The website remained accessible through at least one domain.
  • The operator displayed an international gaming licence.
  • Some states had not enacted detailed online-gambling provisions.

Those points were often turned into an overly broad conclusion that offshore betting was “not expressly illegal” and therefore effectively legal. Even before 2026, that conclusion overlooked state laws, foreign-exchange restrictions, website-blocking powers and financial-regulatory enforcement.

After the PROG Act and its 2026 Rules, relying solely on the Public Gambling Act’s age is especially misleading. The new framework specifically addresses online games played for money, services offered digitally, advertising, payment facilitation, enforcement powers and website blocking. The old “the law does not mention the internet” argument can no longer be treated as a complete answer.

This does not mean every legal question is perfectly settled. Courts may still need to interpret individual provisions, state and central laws can overlap, and liability can depend on the facts of a case. However, there is now a direct central statutory framework dealing with the category of service MELBET provides.

That is the most important correction any current MELBET legality article must make.

What Changed on 1 May 2026?

The most significant date for this topic is 1 May 2026, when the Promotion and Regulation of Online Gaming Rules, 2026 came into force.

The Rules established the operational structure for implementing the Promotion and Regulation of Online Gaming Act, 2025. Government information about the framework describes a distinction between permitted categories such as qualifying e-sports and online social games, and prohibited “online money games” involving monetary stakes and the expectation of financial gain.

The framework also established or operationalised the Online Gaming Authority of India, with functions related to classification, registration of permitted categories, grievance processes and regulatory oversight. It is not a licensing gateway through which offshore sportsbooks can simply obtain permission to continue offering conventional real-money betting.

The core change

Before this framework, an offshore operator could point to the fragmented nature of state gambling law and the age of the Public Gambling Act. After 1 May 2026, the central government has a direct statutory structure aimed at online money gaming.

Official government explanations describe the framework as prohibiting:

  • Offering or facilitating online money games.
  • Advertising or promoting online money games.
  • Processing or facilitating financial transactions connected with online money gaming services.
  • Continued access to prohibited services, including through blocking powers.
  • Conduct by offshore services targeting users in India.

What did not happen on 1 May 2026

Some online articles attach additional claims to the date without providing a primary government record. For example, a source may say that a fully automated system blocked every MELBET mirror domain on that day or that a special agency operation froze thousands of accounts associated specifically with MELBET.

The official materials confirm the commencement of the Rules and the regulatory framework. They do not, by themselves, establish that every domain belonging to a particular operator was blocked on the same date or that every payment to that operator led to a frozen account.

Those claims require separate, case-specific evidence. A reliable legal-status page should distinguish confirmed law from rumours, user reports and unsupported enforcement statistics.

How the PROG Act Applies to MELBET

The Act’s definition of an online money game is deliberately broad. It covers an online game played by a user who pays money or places another stake with the expectation of monetary or equivalent enrichment. The definition is not limited to casino games and is not avoided merely because skill may influence an outcome.

MELBET’s principal products include activities such as:

  • Pre-match sports betting.
  • Live or in-play betting.
  • Casino games played for real money.
  • Slots and crash-style games.
  • Deposits that create a playable balance.
  • Withdrawals based on account winnings.

A conventional sportsbook wager fits the practical characteristics of an online money game: the player stakes money on an uncertain outcome and may receive a financial return if the selection wins.

A casino wager fits even more directly. The user stakes money on a game whose result can lead to a monetary payout or a loss of the stake.

Labelling these products as “entertainment,” “prediction,” “gaming,” “sports engagement” or “international services” does not change their underlying economic structure.

Skill versus chance does not provide an automatic escape

Indian gaming litigation has historically distinguished games of skill from games of chance. That distinction remains relevant in several areas of state law and in the treatment of particular games.

However, the PROG framework’s definition is written to include money games regardless of whether they are based on skill, chance or both. A sportsbook cannot establish legality simply by arguing that an experienced bettor studies statistics, player form or match conditions. The defining issue is the payment of a stake for the expectation of financial gain through an online game.

The operator is offshore, but the service targets India

An offshore location does not create a general exemption when the service is offered to users in India.

Features commonly used to reach Indian users may include:

  • Prices or balances displayed in Indian rupees.
  • India-focused promotional pages.
  • Cricket and IPL betting sections.
  • Indian-language advertising.
  • Local payment interfaces.
  • Customer support marketed to Indian residents.

These features may demonstrate that the service is directed at the Indian market rather than being an unrelated foreign website that an Indian user happened to discover.

The key question is not simply where the company is incorporated. It is whether an online money gaming service is being offered within India or to users in India. The current framework is expressly designed to address offshore as well as domestic operators.

What Does the Law Prohibit?

The current central framework is not limited to placing an operator on a blacklist. It addresses the wider commercial system required to run and promote an online money gaming service.

1. Offering an online money game

The operator-facing prohibition covers offering an online money game or online money gaming service.

For MELBET, this is the most direct legal issue. Its sportsbook and real-money casino products are not merely news, scores, social games or free entertainment. Their primary function is to accept stakes and settle monetary outcomes.

2. Advertising and promotion

The framework prohibits advertising or promoting online money games.

This matters to:

  • Affiliate websites.
  • Social-media influencers.
  • Advertising agencies.
  • Sports-content pages.
  • Video channels.
  • Messaging groups.
  • Publishers using “legal in India” claims to drive registrations.

An article that provides legal information is different from an advertisement. However, a page can become promotional when it combines an unsupported legality claim with bonus codes, urgent deposit prompts, mirror links or prominent registration buttons.

For that reason, a responsible legal-status page should not conclude with “Join now,” “Claim bonus,” “Deposit with UPI” or similar calls to action.

3. Payment processing and financial facilitation

The Act addresses banks, financial institutions and other persons facilitating transactions connected with online money gaming services.

This is one of the most important practical changes. Even when a gambling website remains technically reachable, its payment routes may fail, change suddenly or be investigated.

A platform may display a local bank account or UPI identifier rather than the formal name of the offshore gaming company. That does not necessarily make the payment an ordinary domestic purchase. The true nature and beneficiary of the transaction still matter.

4. Blocking powers

The Act includes powers connected with blocking public access to prohibited online gaming services.

India had already used powers under the Information Technology Act to block large numbers of betting and gambling websites and applications. Government reporting stated that hundreds of offshore or non-compliant online money-gaming websites had been blocked and that enforcement had also involved the freezing or blocking of thousands of bank accounts associated with suspected illegal gaming networks.

A block does not create the prohibition by itself, and a lack of a visible block does not amount to approval. Blocking is one enforcement tool among several.

5. Penalties and criminal procedure

Government explanations of the Act describe significant penalties for offering or facilitating prohibited money games and for advertising them. Offences connected with offering online money games and facilitating related financial transactions may also receive serious criminal-procedure treatment. India Code lists offences under Sections 5 and 7 as cognizable and non-bailable.

That language should not be turned into a claim that every visitor to a betting website automatically commits a non-bailable offence. The relevant provision, the person’s conduct and the available evidence must all be examined.

Is It Illegal for an Individual in India to Use MELBET?

This is where careful wording matters most.

The central Act’s clearly identified prohibitions and penalties concentrate on:

  • Offering online money games.
  • Aiding or facilitating their offer.
  • Advertising or promoting them.
  • Processing or authorising related financial transactions.

That makes the operator, promoter and payment ecosystem the clearest enforcement targets.

It would nevertheless be unsafe to conclude that an ordinary user has complete immunity.

Why user exposure remains possible

An individual’s situation may involve more than privately viewing a website. For example, a person might:

  • Promote an affiliate link for commission.
  • Recruit or refer other players.
  • Collect deposits for other users.
  • Operate a payment account used as an intermediary.
  • Sell access to mirror domains.
  • Administer a betting group.
  • Provide false information to a bank.
  • Receive or transfer funds on behalf of the operator.
  • Participate from a state with a specific player-side prohibition.

These activities may move the person from being a consumer into promotion, facilitation, abetment or payment handling.

State law can also apply independently. The PROG Act contains a provision indicating that it operates in addition to, rather than in replacement of, other laws. Therefore, an individual must consider both the central framework and the law of the state or union territory in which the activity occurs.

The accurate user-level conclusion

A responsible article should not say:

  • “Indian players can legally bet on MELBET.”
  • “Users can never be prosecuted.”
  • “MELBET is legal because no one has been arrested.”
  • “The law only applies to Indian companies.”
  • “A Curaçao licence protects Indian players.”

It should also avoid claiming that merely opening a webpage automatically leads to arrest.

The accurate conclusion is that MELBET’s service is not India-authorised and falls within a prohibited category, while individual liability depends on state law, the user’s conduct and the way money or promotion is handled.

Anyone facing a notice, frozen account, police contact or significant financial dispute should obtain advice from an Indian lawyer who can review the actual documents and applicable state legislation.

Why State Gambling Laws Still Matter

Betting and gambling have traditionally been matters on which Indian states enact legislation. That history produced different legal rules across the country even before the PROG Act.

Several states have adopted stricter provisions dealing with online gaming, wagering or games played for stakes. Other states continue to rely on older gambling statutes or amended versions of the Public Gambling Act.

The central framework now supplies a nationwide prohibition affecting online money games, but it does not erase every state rule. State legislation may still matter when determining:

  • Whether a player’s conduct is separately prohibited.
  • Which police authority can investigate.
  • Whether a particular offence is cognizable.
  • How equipment or funds may be seized.
  • Whether a game receives a state-law skill-game exception.
  • What local procedure applies.
  • Whether an organiser, premises owner or participant faces additional liability.

This is why outdated “state colour maps” should be treated cautiously. A table that labels one state “legal,” another “gray” and another “banned” may omit later amendments, court decisions, central legislation or commencement notifications.

Sikkim and Nagaland do not provide a nationwide exemption

Sikkim and Nagaland have historically maintained forms of state-specific gaming regulation. That does not mean a foreign sportsbook licensed elsewhere may serve every Indian resident.

A state licence generally operates within the scope, game categories and territorial restrictions created by that state’s law. It is not a national passport for MELBET or another offshore operator.

No state silence equals permission

The absence of a detailed state statute naming online sportsbooks does not mean the activity is affirmatively legal. Central legislation, payment restrictions, general criminal provisions and other applicable laws may still operate.

For a personal legal assessment, the relevant questions include where the user was physically located, what activity occurred, how funds moved and whether the person promoted or facilitated the service.

MELBET’s Curaçao Licence Versus Indian Legality

MELBET’s foreign licensing status is one of the most common reasons given for calling the platform “legal.”

The Curaçao Gaming Authority’s certificate database currently lists melbet.com under Pelican Entertainment B.V. and displays licence number OGL/2024/561/0554 as active.

That information answers a limited question:

Does the operator appear to hold a gaming authorisation issued under Curaçao’s regulatory system?

It does not answer:

Is MELBET authorised to offer online money games to people in India?

These are different legal systems.

Curaçao licensing questionIndian legality question
Is the operator licensed by the Curaçao authority? Is the service permitted under Indian central and state law?
Does the operator comply with conditions in its licensing jurisdiction?Does it have an Indian authorisation to offer real-money betting?
Can the foreign regulator supervise the licensee? Can Indian users rely on Indian regulatory and consumer remedies?
Is its domain listed on a foreign licence certificate?Does Indian law permit its products and payment flows?

A foreign licence does not:

  • Repeal the PROG Act.
  • Create an Indian gaming licence.
  • require Indian banks to process gambling transactions.
  • prevent MeitY or another authority from blocking access.
  • convert an online money game into a social game.
  • guarantee that an Indian court or regulator can enforce a payout claim.
  • prove that every advertisement, bonus or mirror domain is official.

The appropriate wording is therefore:

MELBET appears to hold a Curaçao gaming licence, but it does not hold identified Indian authorisation to offer real-money online betting. Its Curaçao licence does not make its Indian-facing services legal.

Website Availability Is Not Proof of Legality

A user may search for MELBET and find a page that loads. That can happen for several reasons:

  • A particular domain has not yet been blocked.
  • The operator has changed domains.
  • Different internet providers apply blocking directions at different times.
  • A page is promotional rather than the gaming service itself.
  • A cached or indexed result remains visible.
  • The user is seeing a cloned or fraudulent page.

None of these possibilities creates legal approval.

The reverse is also true. A website block is an administrative or technical enforcement measure, not a court judgment resolving every possible user-level question. The legal prohibition comes from the applicable legislation; the block is one way authorities may restrict access.

Mirror domains

Offshore gambling operators commonly face domain disruption. Search results may lead to addresses that claim to be a “new official link,” “working mirror” or “unblocked site.”

Such links create several risks:

  • The domain may be controlled by an impersonator.
  • Login details may be harvested.
  • Payment information may be redirected.
  • An APK may contain malicious code.
  • The page may disappear after receiving deposits.
  • The domain may violate the operator’s own account-security rules.

This article does not provide or verify mirror links. A mirror does not cure the underlying legal issue.

VPN use

A VPN changes how an internet connection appears to a website. It does not change Indian law or turn a prohibited online money game into a permitted service.

Location masking can also conflict with an operator’s terms, trigger security reviews or cause a mismatch between an account’s documents, payment location and login history. Users should not assume that a VPN protects their balance, identity or legal position.

APK files

Direct APK installation bypasses the standard review and automatic-update systems associated with an official app store.

A file labelled “MELBET APK” may be:

  • An authentic file distributed by the operator.
  • An outdated version.
  • A modified affiliate package.
  • A clone using MELBET branding.
  • Malware designed to capture messages, passwords or banking credentials.

Do not disable security controls, grant unrestricted SMS access or install files from random download pages. A functioning APK does not establish that the underlying service is lawful.

UPI, Bank Transfers and Payment Risks

Payment availability is another area where legality is commonly misunderstood.

A platform may display:

  • An INR balance.
  • A UPI option.
  • A QR code.
  • The name of an Indian individual or business.
  • A domestic bank account.
  • A “local payment agent.”

Those features do not prove that the operator is registered or approved in India.

Why the payee name may not match MELBET

Offshore platforms may rely on intermediaries, payment agents or rapidly changing collection accounts. The user may transfer money to an account that does not visibly identify itself as a betting company.

This creates several problems:

  1. The bank statement may not clearly explain the true purpose of the payment.
  2. The payee may be an unrelated intermediary.
  3. The payment may not be credited automatically.
  4. The receiving account may later be investigated.
  5. The sender may struggle to prove the commercial relationship.
  6. A dispute may fall outside ordinary card or merchant chargeback processes.

The post-May 2026 framework specifically restricts financial facilitation for online money gaming services. A local-looking UPI transaction does not remove the underlying regulatory problem.

Can a user’s bank account be frozen?

It is inaccurate to say that every payment to an offshore betting service causes an automatic freeze.

However, the risk is not imaginary. Indian enforcement agencies have reported actions against payment networks and bank accounts connected with suspected illegal offshore online money gaming. In March 2025, the Directorate General of GST Intelligence reported the blocking of hundreds of offshore gaming websites and the blocking or freezing of approximately 2,400 bank accounts, with funds also frozen during enforcement.

A freeze can occur when investigators trace funds through an account suspected of receiving or transferring unlawful proceeds. A sender may then be asked to explain the transaction even if the person did not understand the wider network.

The outcome depends on the bank, investigating authority, transaction trail and facts of the case. It is wrong to promise that the money is “permanently lost,” just as it is wrong to say that no banking consequence is possible.

Red flags before any payment

Do not send money when:

  • The payee changes repeatedly.
  • Support asks for payment to a private individual.
  • A representative requests an OTP or UPI PIN.
  • The amount or merchant description differs from the transaction shown.
  • A withdrawal requires an additional “tax,” “unlock” or “verification” payment.
  • Support insists that a deposit must be repeated because the first one is “stuck.”
  • The platform asks the user to receive and forward money for other customers.
  • A person offers commission for allowing use of a bank account.

Using a personal bank account as a collection or forwarding account can create much more serious exposure than merely being a customer.

KYC, Privacy and Identity Risks

An offshore betting account may require documents before permitting a withdrawal. Typical requests can include identification, proof of address, a payment statement or an image of the account holder.

KYC is not automatically evidence of fraud. Regulated gambling operators commonly use identity checks to address age, fraud and anti-money-laundering concerns.

The problem for an Indian user is the combination of sensitive documents, offshore data handling and limited domestic recourse.

Questions to ask before uploading documents

  • Which legal entity is collecting the information?
  • Where will the files be stored?
  • What privacy policy governs them?
  • How long are the documents retained?
  • Is the domain shown on the foreign licence certificate?
  • Does the request come from the authenticated account interface?
  • Is support asking for unnecessary information?
  • Is the user being asked to send an unredacted card image?
  • Is a representative requesting an OTP, PIN or password?

No legitimate verification process should require a banking password, UPI PIN, email password, recovery phrase or one-time password.

Identity documents are difficult to recover

Money can sometimes be disputed or traced. A leaked identity document cannot simply be replaced in the same way as a password.

Possible consequences of document misuse include:

  • Fraudulent account creation.
  • Loan or payment-account applications.
  • Social-engineering attacks.
  • Impersonation.
  • SIM-related fraud.
  • Targeted phishing.
  • Attempts to reset financial accounts.

An offshore licence may provide some regulatory oversight, but it does not guarantee that an Indian user will receive the same remedies available from a domestically regulated financial service.

Withdrawal and Dispute Risks

A platform’s ability to accept a deposit is not proof that it will release a withdrawal without delay.

Withdrawal reviews may involve:

  • Identity verification.
  • Payment-method ownership checks.
  • Source-of-funds questions.
  • Bonus wagering conditions.
  • Duplicate-account reviews.
  • Location discrepancies.
  • Unusual login patterns.
  • Sports-integrity or suspicious-betting checks.

Some of these controls have legitimate compliance purposes. They can nevertheless leave an offshore user dependent on the operator’s internal process.

No Indian licence means weaker local remedies

When a dispute involves a domestically regulated bank, payment company or licensed service provider, an Indian consumer may have a defined complaint path.

With an offshore betting operator, important obstacles can include:

  • A foreign contracting entity.
  • Foreign governing-law clauses.
  • Mandatory overseas dispute procedures.
  • Unclear ownership of mirror domains.
  • Difficulty serving legal documents.
  • Limited enforcement of an Indian order abroad.
  • No India-based gaming ombudsman responsible for the operator.

It is too absolute to say that an Indian court can never hear any dispute. Courts can consider jurisdiction based on the facts. The more practical issue is whether a claim can be brought economically and whether any resulting order can be enforced against the foreign operator.

No article should promise easy legal recovery of a betting balance.

Are MELBET Winnings Taxable in India?

Legality and tax are separate questions.

Section 115BBJ of the Income-tax Act provides a 30% tax rate on net winnings from online games, subject to applicable surcharge and cess. The existence of a tax rule does not legalise the activity that generated the income.

A common but incorrect argument is:

“The government taxes online gaming winnings, so online betting must be legal.”

Tax systems frequently impose obligations on income without approving the conduct that produced it. A person may still have reporting obligations even when an operator is offshore or when the underlying activity is restricted.

Offshore operators and TDS

A foreign operator may not apply Indian tax deduction procedures in the same way as a domestic, compliant platform. That does not necessarily remove the Indian resident’s obligation to report taxable income.

The correct treatment can depend on:

  • The definition of net winnings.
  • Deposits and withdrawals during the financial year.
  • Account balances.
  • Currency conversion.
  • Whether tax was deducted anywhere.
  • The source and location of receipts.
  • The user’s residential status.
  • Other disclosure requirements.

Keep complete transaction records and consult a chartered accountant for an individual calculation. Do not rely on an offshore account statement or a promotional FAQ as personal tax advice.

How to Check MELBET’s Legal Status Yourself

Legal-status pages become outdated. Readers should know how to verify the main claims rather than trusting a “100% legal” badge.

Check 1: Read the current Act on India Code

Search India Code for the Promotion and Regulation of Online Gaming Act, 2025. Confirm that you are reading the official Act rather than a blog summary.

Review:

  • The definition of an online money game.
  • The prohibition on offering online money games.
  • The advertising prohibition.
  • The restriction on related financial transactions.
  • Blocking powers.
  • Penalty provisions.
  • The provision dealing with other applicable laws.

Check 2: Confirm the Rules and commencement date

Review the official Promotion and Regulation of Online Gaming Rules, 2026 and government commencement information.

The Rules took effect on 1 May 2026 and created the framework for classification, permitted-game registration and regulatory administration.

Check 3: Identify the product, not the marketing label

Ask what the service actually does.

A product is likely to fall within the online-money-game category when:

  • A user deposits or stakes money.
  • The result is uncertain.
  • The user expects money or a money-equivalent reward.
  • The service settles wins and losses.

Calling the product “sports entertainment,” “prediction,” “exchange,” “gaming” or “international betting” does not replace this functional test.

Check 4: Search for Indian authorisation

Do not confuse a foreign licence with an Indian approval.

Look for:

  • The name of the Indian authority.
  • The statutory provision authorising the service.
  • The legal entity receiving the authorisation.
  • The permitted games.
  • Territorial restrictions.
  • The validity period.
  • A public authority record.

An affiliate logo or a statement reading “internationally licensed” is not enough.

Check 5: Verify the Curaçao certificate separately

The official Curaçao Gaming Authority certificate currently associates melbet.com with Pelican Entertainment B.V. and licence OGL/2024/561/0554.

Confirm the exact domain. A similar-looking mirror or clone may not appear on the certificate.

Remember that this verifies foreign licensing only. It does not prove Indian legality.

Check 6: Review the law of your state

Central legislation is not the only relevant law. Check the latest state act, amendments, commencement notifications and court decisions.

Do not rely on a generic chart copied from an old competitor article.

Check 7: Separate access from approval

Ask:

  • Is the site merely reachable?
  • Has any Indian authority licensed it?
  • Is the payment route transparent?
  • Does the operator identify the legal payee?
  • Is an affiliate using “legal” as a marketing claim?
  • Is the page directing users to a mirror or APK?

A technically working site answers none of the central legal questions.

Claims About MELBET That Should Be Treated Cautiously

“MELBET is 100% legal in India”

This is not supported by the present central framework. MELBET has no identified Indian authorisation, and its real-money products fit the category the PROG legislation prohibits.

“MELBET is legal in every state except a few banned states”

This reflects an outdated state-only analysis. It ignores the central online-money-gaming framework operational from 1 May 2026.

“MELBET is legal because it has a Curaçao licence”

A foreign licence does not override Indian law.

“MELBET is legal because it accepts UPI”

A payment option is a technical feature, not a legal approval.

“MELBET is legal because the website opens”

Accessibility can change by domain, network and enforcement action. It is not a licence.

“Individual betting is never an offence”

That is too broad. Central and state provisions, facilitation, payment handling and the facts of the person’s conduct all matter.

“Every MELBET user will be arrested”

That is also unsupported. Enforcement priorities and liability vary, and the law does not permit a one-sentence conclusion for every individual case.

“All user funds will be permanently frozen”

Enforcement agencies have frozen accounts connected with suspected offshore-gaming networks, but the result of a particular transaction depends on the evidence and legal process.

“Paying tax makes the betting legal”

Tax liability and legality are separate.

What to Do If You Already Have a MELBET Account

This section is not a guide to continuing to bet. It addresses account, identity and record-protection issues.

Stop adding money

Do not deposit additional funds merely because support says a payment, withdrawal or account must be “activated.” A demand for another deposit to release an existing balance is a serious warning sign.

Preserve evidence

Save:

  • Account statements.
  • Deposit and withdrawal records.
  • Bank references.
  • Emails and support messages.
  • Screenshots of disputed transactions.
  • The domain used.
  • The legal-entity name shown in the terms.
  • Copies of documents submitted.
  • Dates and times of account restrictions.

Do not edit screenshots or fabricate records.

Do not share security credentials

Never provide:

  • UPI PINs.
  • Banking passwords.
  • Email passwords.
  • One-time passwords.
  • Card PINs.
  • Cryptocurrency recovery phrases.
  • Remote access to your phone or computer.

Contact the bank promptly if fraud is suspected

Tell the bank what happened accurately. Do not disguise the transaction as a different type of purchase.

For suspected cyber fraud, India’s official cybercrime reporting mechanisms may also be relevant. Preserve the complaint number and all supporting documents.

Obtain legal advice after a freeze or notice

Do not ignore:

  • A bank-account freeze.
  • A police or cyber-cell notice.
  • A request for an explanation of transactions.
  • A tax notice.
  • A demand involving funds received from unknown persons.

A lawyer can determine which authority issued the action, what documents are required and whether an application for release or clarification is appropriate.

Responsible Gambling and Financial Harm

The legal position is only one part of the risk.

Sports betting and casino games are designed around a mathematical operator advantage. Short-term wins do not remove that advantage, and they do not turn betting into a stable source of income.

Sportsbook margin

A sportsbook builds a margin into its odds. The combined implied probabilities of all possible outcomes usually exceed 100%, allowing the operator to retain an expected percentage over a large volume of bets.

Knowledge of cricket, football or player statistics can affect a person’s opinion, but it does not eliminate:

  • Incorrect information.
  • Random match events.
  • Injuries.
  • Weather changes.
  • Price movement.
  • Operator margin.
  • Emotional decision-making.

Casino house edge

Casino games use rules and payout tables that provide the operator with a long-term mathematical advantage.

A game displaying a theoretical 96% return to player does not promise that an individual will recover 96% of a deposit. RTP is calculated over a very large number of rounds, while one person’s result can be far worse.

Signs that gambling is causing harm

Take the problem seriously when a person:

  • Chases previous losses.
  • Borrows to bet.
  • Uses money needed for essentials.
  • Hides transactions from family.
  • Bets for longer than intended.
  • Feels unable to stop.
  • Becomes distressed when unable to gamble.
  • Increases stakes to achieve the same excitement.
  • Believes one large win will solve debt.
  • Continues after work, relationships or health are affected.

The appropriate response is not a larger wager or a new bonus. It is to stop, restrict access to money, speak to someone trusted and obtain professional support.

Frequently Asked Questions

Is MELBET legal in India in 2026?

MELBET should not be described as a legal or India-authorised betting platform. Its sportsbook and real-money casino products fall within the broad concept of online money games prohibited under the Promotion and Regulation of Online Gaming framework. The 2026 Rules came into force on 1 May 2026.

Was MELBET legal before 1 May 2026?

Before the current framework became operational, offshore betting was frequently described as a gray area because central gambling law was old, state rules varied and no national statute directly addressed every form of online betting.

That did not necessarily make MELBET legal. Website blocking, state gambling statutes, financial rules and other laws still applied. The 2025 Act and 2026 Rules made the central position against online money games substantially more direct.

Is MELBET banned in India?

The more precise statement is that MELBET’s real-money services fall within a prohibited category and may be subject to access blocking and payment restrictions.

Public primary materials do not necessarily identify every active MELBET domain by name. Domains can also change. Therefore, do not rely on a claim that one permanent brand-wide URL list proves the entire legal position.

Does MELBET have an Indian licence?

No Indian gaming authorisation for MELBET has been identified.

Its Curaçao licence is a foreign authorisation issued under Curaçao’s regulatory system. It is not an Indian licence.

Does a Curaçao licence make MELBET safe or legal?

It may show that the named operator and domain are licensed in Curaçao. It does not establish legality in India, guarantee payment of every withdrawal or give the operator permission to use Indian banking channels.

Can I legally use MELBET from a state without a specific online-betting ban?

The central online-money-gaming framework now applies nationally, so state silence cannot be treated as permission.

State law may create additional exposure, but the absence of a specific state ban does not neutralise the central prohibition on offering and financially facilitating online money games.

Can I be arrested merely for having a MELBET account?

The law does not support a blanket claim that every account holder will be arrested.

The central offence provisions are principally directed at offering, advertising and facilitating money games and payments. Risk increases when a person promotes the platform, handles funds for others, operates payment accounts, facilitates access or violates an applicable state provision.

For personal advice after a notice or investigation, consult a lawyer.

Is using a VPN to access MELBET legal?

A VPN does not change the legal status of the service. It may also create security, identity-verification and account-location conflicts.

This article does not recommend using a VPN or another access workaround.

Is a MELBET mirror site legal?

A mirror is an alternative technical route to a service. It does not create a licence or exemption.

Mirror pages also carry impersonation, phishing, malware and payment-redirection risks.

Is it safe to download the MELBET APK?

Direct APK installation carries additional security risk because the file may be outdated, altered or fraudulent.

Do not install files from random mirrors, disable device protections or grant unnecessary SMS, accessibility or storage permissions. App availability does not establish legality.

Can I deposit on MELBET using UPI?

A visible UPI option does not prove that MELBET is approved in India.

The payment may be routed through an intermediary or changing domestic account. Current central law restricts financial facilitation for online money gaming services, and enforcement agencies have acted against accounts associated with suspected offshore gaming networks.

Could my bank account be frozen?

A freeze is not automatic for every user, but it can happen when an account appears in a transaction trail connected with suspected unlawful activity.

If an account is frozen, obtain the written reason or reference number from the bank, preserve records and seek legal advice.

Are MELBET winnings taxable?

Online-game winnings can be taxable at 30% under Section 115BBJ, plus applicable surcharge and cess. Taxability does not make the underlying service legal.

Can I recover money through an Indian consumer court?

That depends on jurisdiction, the contracting entity, the transaction and enforceability. An offshore operator without Indian authorisation creates significant practical obstacles.

Do not assume an Indian regulator can order an immediate payout in the same way it might address a complaint against a domestically regulated financial institution.

Is MELBET legal because it sponsors teams or advertises online?

No. Sponsorship visibility, search advertisements, influencer promotion or affiliate reviews do not amount to government authorisation.

The current central framework separately prohibits advertising and promotion of online money games.

What is the difference between MELBET being accessible and legal?

Accessible means a website or application currently loads.

Legal means the service is permitted under the applicable legislation and has any authorisation required to operate.

A service can be accessible while prohibited, and a blocked service can still raise legal questions beyond the blocking order.

What is the safest conclusion for an Indian reader?

Do not treat MELBET as a legal Indian betting platform. It lacks identified Indian authorisation, its principal products fit the prohibited online-money-game category, and its foreign licence does not override Indian law.

Final Verdict

The answer to “is MELBET legal in India?” is no longer accurately expressed as a simple pre-2026 “gray area.”

As of 1 August 2026:

  • India has a central statute specifically addressing online money games.
  • The implementing Rules came into force on 1 May 2026.
  • The framework prohibits offering online money games, advertising them and facilitating related transactions.
  • Its scope is designed to address services offered into India, including relevant offshore operations.
  • MELBET’s sportsbook and casino products involve monetary stakes and expected monetary returns.
  • MELBET does not have identified Indian authorisation.
  • Its Curaçao licence does not override Indian law.
  • Website access, UPI availability and an INR display do not prove legality.
  • State laws may add further user-level exposure.
  • Tax obligations can arise without legalising the activity.
  • Individual liability requires a fact-specific assessment rather than an unsupported blanket claim.

Therefore, MELBET should not be promoted or described as legal in India in 2026.

Readers should avoid registration, deposits, mirror sites, direct APK files and technical workarounds based on claims that the platform is “100% legal.” Anyone dealing with a frozen bank account, missing funds, a government notice or a tax question should seek advice from a qualified Indian lawyer or chartered accountant.
